Authorization To Return

Have you ever been issued a departure order, deportation order or exclusion order?

Once a foreign national is asked to leave Canada in order to return legally. Such applicant needs to apply for an Authorization to Return to Canada (ARC). This is an official means to ask the Canadian government for permission to re-enter the country.

The following are the types of removal orders:

  • Departure order
  • Deportation order
  • Exclusion order

Departure order

If you receive a departure order, you must leave Canada within 30 days and confirm your departure with an immigration officer at the port of exit. If the individual complies with these conditions and follow due process, then you do not need an ARC. You may return to Canada subject to normal examination at the port of entry. But if you left the country without confirming your departure, or more than 30 days after the Departure Order was issued, the Departure Order automatically becomes a Deportation Order and you need to apply for an ARC. Deportation order

Folks who receive a deportation order and individuals who were initially issued a departure order that became a deportation order require an ARC to re-enter Canada lawfully. But if you received a Departure Order and left Canada within the required 30 days and verified your departure with a Canadian immigration officer at the port of exit, then you do not need an ARC. You may return to Canada subject to normal inspection at the port of entry.

Exclusion order

Folks who receive an exclusion order need to wait 12 months have passed since you left Canada and you have a Certificate of Departure showing the date you left Canada as confirmation. Therefore, you do not need an ARC. You may return to Canada subject to standard examination at the port of entry. But you need an ARC if you wish to return to Canada less than 12 months after the Exclusion Order was issued or if you do not have a Certificate of Departure as it would be needed.
